“My Neighbor Said They Had a Survey” Why Boundary Surveys Matter

Hi, my name is Shelley and I’m with Cardinal Surveying. When I talk to you guys today about boundary surveys and also about the fact that, you know, neighbors sometimes tell us what they think is truth or what they just want us to hear. And the whole purpose of us getting a boundary survey is to make it known what you own.

And what that means is knowing exactly where your property corners are, where your property lines are located, where your ownership starts, and where your neighbor’s ownership starts. And this particular example, we are lot number 56. We happen to have a conversation with the neighbor at lot 55. When we were doing this survey, and the conversation went something like, oh, hey, I wanted to let you know I had a survey done.

You don’t need to worry about any of this stuff over here. It’s all on our property. We had the survey done and we’re good to go. Well, as we did the survey and as we looked for survey monuments, we did not find property corners along this property line. We actually placed these property corners in the ground ourselves based on where the subdivision class said they belonged.

The closest corner that we found to lot 55 was actually located 300ft away, which is an indicator that they have not had a boundary survey done. And they probably really did not know what they owned. Now they could have had a surveyors real property report done, but as we know, surveyors were property report does not mark property corners and it should not be used or relied upon to establish any fence or other structure.

When we look at the detail of our lot, what we start to find is not only did this neighbor not know where their property line was, they also built stuff all over the place. All of these items in red are areas of concern and things that need to be addressed, because they’re actually built on the wrong property. So you’ve got a fence that’s built onto the property.

Now, granted, this is 1.5ft onto our property, but it’s still our land that they’re using. So we’ve got some concrete. We’ve got a pergola here which is a major structure. And again, they have no legal right to have these items on our land. If you want to make it known what you own, have a boundary survey performed today.
