Offsite Easements

This month we continue with a commercial real estate blog series that covers each item in an ALTA survey checklist, otherwise known as TABLE A. We will look at the benefits of each point in detail. An ALTA survey is typically utilized for commercial and industrial properties only. The requirements to perform an ALTA allow for several additional features to be added to the typical boundary survey.

18. Pursuant to Sections 5 and 6 (and applicable selected Table A items, excluding Table A item 1), include as part of the survey any plottable offsite (i.e., appurtenant) easements disclosed in documents provided to or obtained by the surveyor.

In most instances, utility lines run from the building directly towards the street and the right of way. There are instances where utility lines must cross a neighboring property to get to the main line for connection. When that occurs, the location of the utility line should be shown, and a supporting easement document should be referenced. It should be noted that the surveyor does not research the easements located onto or across adjoining properties. The information regarding easements should be provided by the client in the form of a title commitment. The easements referenced in that document should be provided to the surveyor and shown in the survey drawing. If an easement is not provided for a utility line, it should be noted on the drawing as well.
