An encroachment is an object that is located on the incorrect property, meaning it is encroaching onto someone else’s land. You would typically see this in instances regarding driveways, landscaping, retaining walls, and most commonly with fences. There are instances when individuals build their fence without having a survey performed later to find out they have built the fence on their neighbors property. In this instance the fence would be said to be encroaching onto the neighbor.
